Introduction and Scope Note

Congress enacted and the President signed into law the Small Business Reorganization Act of 2019. The new law took effect February 19, 2020 as Subchapter V of Chapter 11, beginning at 11 USC Sec 1181 and following. Please take and make use of the accompanying monograph and its appendices. Yes, it is technical, full of cross-references (footnotes), and not a particularly easy read for someone who has never dealt with Bankruptcy.  It is a seminar level piece, designed to guide lawyers and business owners through the difficult decisions needed to rescue a business in trouble. I am an experienced bankruptcy lawyer. The main piece has a subtitle: “Advising the Small Business Debtor.” The main text includes a practice hint, here and there, based on my half century of tactical know-how in the art of saving the sick business.  There are 6 appendices, for those interested in additional depth.
